Terms and Conditions
1. Application of These Terms
1.1 These Terms and Conditions (“Terms”) apply when you:
(a) create an employer account with Rapid Screening Pty Ltd (or attempt to do so);
(b) have, or have access to, an employer account with Rapid Screening;
(c) utilize any of our services, including background checks, employment screening, or related services provided through Rapid Screening (our platform);
(d) post, or attempt to post, any data or advertisements for employment or background screening services on our platform; or
(e) otherwise agree to be bound by these Terms.
1.2 These Terms bind both the individual and any business or organization they represent (or claim to represent). References to “you” and “your” apply to both individuals and organizations.
1.3 Your access to, and use of, our platform and services is conditional upon your acceptance and continued compliance with these Terms. For clarity, all references to “our platform” refer to all services provided under Rapid Screening, including websites, apps, APIs, or other tools that support our services.
2. Additional Specific Terms
2.1 Depending on the services you utilize, additional specific terms may apply to your use of those services (“Additional Specific Terms”).
2.2 All Additional Specific Terms are incorporated into these Terms. If there is any inconsistency between these Terms and the Additional Specific Terms, the Additional Specific Terms will take precedence.
3. Definitions
3.1 “Applicable Laws” means all laws, regulations, by-laws, ordinances, codes of conduct, implementing rules, and issuances from authorized bodies that apply to you and your use of our services.
3.2 “Australian Consumer Law” refers to Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.
3.3 “Credit Laws” mean laws and regulations applicable to financial services and consumer credit in various jurisdictions, including but not limited to: the Philippines Credit Information System Act of 2008, the Singapore Credit Bureau Act 2016, and other relevant credit laws.
3.4 “Privacy Laws” means privacy and data protection laws applicable in any relevant jurisdiction, including the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles, among others.
3.5 “Personal Information” refers to any information that identifies or could reasonably identify an individual, including sensitive data such as personal identifiers, financial details, employment history, and background information.
3.6 “Rapid Screening” means Rapid Screening Pty Ltd (ABN 63 612 155 987) and its related bodies corporate as defined by the Australian Corporations Act 2001 (Cth). References to “we,” “us,” and related terms refer to Rapid Screening Pty Ltd unless otherwise stated.
4. Payment
4.1 Unless otherwise agreed in a separate advertising or service agreement, all amounts due to Rapid Screening must be paid within 14 days of invoice.
4.2 You are responsible for full payment for services rendered, regardless of whether you fully use or utilize those services.
4.3 Payments must be made using accepted payment methods. If payments are late, we may disable your account and services.
4.4 Rapid Screening reserves the right to charge late fees or penalties for delayed payments.
5. Intellectual Property
5.1 Rapid Screening owns all intellectual property associated with the platform, including design, software, trademarks, and content.
5.2 By using our platform, you grant us a non-exclusive, royalty-free license to use your intellectual property (including logos, trademarks, and materials) for service delivery.
5.3 You may not copy, modify, or distribute our intellectual property without prior written consent.
6. User Obligations
6.1 You agree to comply with all applicable laws, protect personal and sensitive data, prevent introducing viruses or harmful content to our systems, and ensure information provided to Rapid Screening is accurate and current.
6.2 You must not use our services to discriminate or violate anti-discrimination laws when evaluating candidates.
7. Data Privacy and Confidentiality
7.1 We handle personal data according to our Privacy Policy.
7.2 You must comply with privacy and data protection laws and only use personal data obtained via Rapid Screening for employment screening and recruitment purposes.
7.3 If you collect sensitive information (e.g., health data), you must ensure compliance with applicable laws.
8. Use of Services
8.1 You agree that any advertisements, job postings, or candidate data you submit will comply with employment and advertising laws.
8.2 You must not post misleading or fraudulent ads, promote illegal activities or pyramid schemes, or engage in actions that could harm Rapid Screening’s reputation.
9. Changes to Services
9.1 Rapid Screening may modify, suspend, or discontinue any service or feature with reasonable notice.
9.2 We may update these Terms to reflect changes in services, laws, or practices.
10. Termination of Account
10.1 We reserve the right to suspend or terminate your account at our discretion if you breach these Terms or violate applicable laws.
10.2 Upon termination, access to your data may be lost; you are responsible for downloading relevant data before termination.
10.3 If you request account termination, we will provide all relevant data to your nominated contact email within 20 business days, unless otherwise required by law.
11. Limitation of Liability and Disclaimer
11.1 To the maximum extent permitted by law, Rapid Screening is not liable for indirect, consequential, or special damages, including loss of profit or data.
11.2 We do not guarantee the accuracy of background checks or other data provided via our platform; you are responsible for verifying all information.
12. Indemnity
12.1 You agree to indemnify Rapid Screening, its officers, employees, and agents from any claims, damages, or expenses resulting from (a) your violation of these Terms, (b) fraudulent or unlawful use of the platform, or (c) breaches of privacy or data protection laws.
13. Governing Law
13.1 These Terms are governed by the laws of [Insert Jurisdiction]. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any disputes arising from these Terms.
14. Changes to These Terms
14.1 Rapid Screening may amend these Terms at any time. Notice of significant changes will be provided via an updated version posted on the platform.
15. Miscellaneous
15.1 These Terms constitute the entire agreement between you and Rapid Screening regarding the use of our platform. Amendments must be in writing.
15.2 If any part of these Terms is unenforceable, the remainder will still apply.
15.3 You may not transfer or assign your rights or obligations without prior written consent.
